Legal Turmoil Surrounds Amadea Superyacht Auction

The luxury superyacht Amadea, originally valued at $325 million, is scheduled for auction in the United States next month. However, ongoing disputes regarding its ownership may complicate the sale and discourage potential buyers, particularly in the Gulf region.

This 106-meter yacht, crafted by the German shipyard Lürssen with interiors designed by noted French architect François Zuretti, was seized by the US Department of Justice in 2022 while it was docked in Fiji. US authorities claim that Amadea is owned by sanctioned Russian billionaire Suleiman Kerimov, although official documentation names non-sanctioned Russian businessman Eduard Khudainatov as the owner. Khudainatov has initiated multiple legal actions to reclaim the yacht, the latest of which was filed on August 22.

Bidders interested in acquiring the yacht will be required to deposit $10 million in escrow and demonstrate a net worth of at least $500 million to qualify for participation in the auction. Currently docked in San Diego, California, the yacht will be sold “as is, where is.”

Amadea is designed to accommodate 16 guests and more than 30 crew members. Its opulent interior features extensive marble, eight state rooms, a beauty salon, a spa, a gym, a helipad, a swimming pool, and an elevator, along with a cruising range exceeding 8,000 nautical miles.

However, experts caution that ownership rights may be contested outside of US territorial waters. “Purchasing this yacht equates to acquiring a floating lawsuit,” remarked Paul Stephan, a law professor at the University of Virginia, in an interview.

Former owners or their representatives might challenge new claims in foreign courts, risking detainment or seizure of the yacht. Countries like Turkey and the Maldives do not automatically acknowledge US asset seizures, with Turkish courts previously indicating a willingness to entertain property claims from Russians.

Analysts indicate that the unresolved ownership issues related to Amadea could complicate financing, insurance, and operational logistics. Potential charter clients may steer clear of vessels embroiled in legal disputes, while captains might face limitations on port access. Additionally, the resale value of the yacht could be significantly impacted, as contested assets typically do not reach their full market potential.

Khudainatov’s legal representatives have expressed similar apprehensions. “We are skeptical that it will draw any reasonable buyers at its market price due to the likelihood of ownership disputes in courts beyond the United States,” stated Adam Ford, spokesperson for Khudainatov’s chief attorney.

The financial burden associated with maintaining Amadea is substantial. Court documents reveal that the yacht incurs monthly upkeep costs of approximately $600,000, in addition to $140,000 for insurance. Insurers often hesitate to provide coverage for assets with contested ownership, frequently imposing inflated premiums or outright refusing to underwrite such properties.

Moreover, cultural and ethical considerations may further diminish interest in the Gulf region. Some institutions and partners in that area view seized assets as problematic under Islamic commercial principles, complicating any potential sale.

Due to these myriad challenges, experts predict that there will likely be limited global interest in the upcoming auction of Amadea.
