ADGM Courts have announced the establishment of the Pro Bono Mediators Panel, representing a significant advancement in their Court-Annexed Mediation Scheme, which was first launched in 2019 as a regional initiative.
The purpose of this initiative is to enhance accessibility to justice while simultaneously nurturing global mediation skills.
The newly formed panel will include internationally recognized mediators who voluntarily provide their services. In exchange for their contributions, these mediators will gain valuable hands-on experience in managing mediations within a prestigious international commercial context.
The inaugural group of mediators has already been selected, with plans for additional application rounds in the future.
This panel is designed to assist individuals seeking prompt and affordable resolution of disputes within the jurisdiction of ADGM Courts, promoting mediation as a practical substitute for litigation.
According to a court statement, “Mediation provides a private setting for parties to collaboratively work towards resolving their disputes while retaining complete control over the negotiations.”
If the parties come to a written agreement that is signed, it becomes legally enforceable. Furthermore, if legal proceedings are still active, ADGM Courts will issue an order to give effect to the settlement, which can be enforced at the request of either party.
The establishment of the mediators panel as a crucial advancement in the scheme
Linda Fitz-Alan, the Registrar and Chief Executive of ADGM Courts, noted that the Court-Annexed Mediation Scheme has consistently achieved an impressive average settlement rate of 80 percent each year since its launch.
She characterized the introduction of the Pro Bono Mediators Panel as “a vital progression” in the development of this scheme.
“This initiative underscores ADGM Courts’ enduring commitment to promoting mediation as an exceptional method for resolving disputes, particularly in the context of emerging challenges related to technology and climate issues,” remarked Fitz-Alan.
Mediation at ADGM Courts can either be facilitated by court officials or by independent pro bono mediators appointed by the registrar.
This initiative is in alignment with ADGM’s broader objectives of enhancing dispute resolution mechanisms and fostering efficient legal processes within Abu Dhabi’s international financial hub.
